TECHCONET CC – TERMS AND CONDITIONS & ACCEPTABLE USE POLICY (AUP)

1. INTRODUCTION & LICENSING

1.1. These Terms and Conditions (“Terms”) govern the relationship between Techconet CC (Registration Number: 2003/039340/23), located at 31 Lobelia Street, Riversdale, 6670 (“Techconet”), and any person or entity using our services (“the Customer”). 1.2. Licensing Status: Techconet CC is a legally authorized provider of electronic communications services and networks, operating under the following ICASA authorizations:

  • ECS Exemption: CAS-215812-J3C2J4

  • ECNS License: 2905/CECNS/OCT/2024

  • 1.3. By activating a Wi-Fi Voucher or using a Fixed Wireless (PPPoE) connection, the Customer agrees to be bound by these Terms and the Acceptable Use Policy (AUP) contained herein.

2. RICA & LEGAL COMPLIANCE

2.1. In accordance with the RICA Act, Techconet will not activate any service until the Customer has provided a certified copy of their ID/Passport and Proof of Residence.

2.2. Techconet is legally required to store connection logs (including IP addresses, MAC addresses, and session times) for a period of 180 days. These logs will only be released to law enforcement upon a valid legal directive.

3. SERVICE PROVISION, EQUIPMENT & MAINTENANCE

3.1. Best Effort: Services are provided on a “Best Effort” basis. Wireless speeds may fluctuate due to weather, interference, or network load.

3.2. Techconet Equipment & Recovery: All antennas (CPEs), brackets, routers and cabling installed at the Customer’s premises remain the property of Techconet CC unless purchased outright and paid for in full.

  • Recovery Rights: Techconet CC reserves the right to recover all proprietary equipment if the service has been suspended for non-payment or canceled by either party.

  • Liability for Cost: Should the Customer fail to provide access for equipment recovery, or if the equipment is lost, stolen, or damaged while in the Customer’s possession, the Customer will be held accountable for the full replacement cost.

  • 3.3. Installation & Relocation:

  • Installation Approval: It is the Customer’s responsibility to designate the exact location for the installation of the antenna, cabling, and router. By allowing the technician to complete the installation, the Customer approves the placement.

  • Relocation Costs: Once the technician has left the premises, any request to move, relocate, or re-install equipment (e.g., moving a router to a different room or moving an antenna) will be treated as a new service request and will be fully billable to the Customer at Techconet’s standard rates.

  • 3.4. Damage & Liability: Techconet is not responsible for equipment damage caused by lightning, power surges, or load shedding. Customers are encouraged to use high-quality surge protectors. 3.5. Fault Reporting & Call-Out Charges:

  • Before requesting a technician call-out, the Customer must perform basic troubleshooting as directed by Techconet support (e.g., checking power cables and restarting the router).

  • Customer-Induced Faults: If a technician is dispatched for a reported fault and the cause of the fault is found to be due to the Customer’s own equipment, configuration changes, negligence (e.g., equipment unplugged or cables damaged by the customer), or no fault is found on Techconet’s network, the Customer will be held responsible for the full call-out fee and labor costs.

4. BILLING & CANCELLATION

4.1. Fixed Wireless: Monthly subscriptions are payable in advance by the 1st of each month. Accounts unpaid by the 3rd will be automatically suspended.

4.2. Cancellation: Fixed Wireless customers must provide one (1) calendar month’s written notice for cancellation via email to admin@techconet.co.za.

4.3. Vouchers: Prepaid vouchers are non-refundable once issued or activated.

5. ACCEPTABLE USE POLICY (AUP)

5.1. Illegal Activity: Usage must comply with the Cybercrimes Act 19 of 2020, including no hacking or fraud.

5.2. Child Pornography (Zero Tolerance): Any hosting or viewing of child pornography will be reported to the SAPS immediately in terms of the Film and Publication Act.

5.3. Copyright Infringement: Unauthorized downloading (torrents) or sharing of copyrighted material is prohibited.

5.4. System Security: DDoS attacks or attempting to circumvent security is strictly prohibited.

5.5. Spam: Sending unsolicited bulk email (SPAM) is prohibited.

6. PROTECTION OF MINORS

6.1. Techconet encourages parents to supervise internet usage. In compliance with FPB regulations, we recommend the following online safety resources:

7.1. Formal Take-Down Notices for copyright or rights infringement must be sent to admin@techconet.co.za.

 

8. LIMITATION OF LIABILITY & INDEMNITY

8.1. Techconet CC shall not be liable for any loss of data, loss of profits, or damages resulting from downtime.

8.2. Indemnity: The Customer indemnifies Techconet CC against all loss or damage arising from the use of the service.

9. AMENDMENTS

9.1. Techconet CC reserves the right to amend these Terms at any time. The latest version will be available on the Techconet website.

 

10. GOVERNING LAW

10.1. These Terms are governed by South African law. Any disputes will be subject to the jurisdiction of the Magistrate’s Court in Riversdale.

 

11. ICASA CODE OF CONDUCT & COMPLAINTS HANDLING

11.1. Code of Conduct: Techconet CC is committed to the ICASA Code of Conduct for Electronic Communications Licensees, ensuring fair and transparent service to all customers.

11.2. Complaints Procedure: All technical or billing complaints must first be lodged in writing to admin@techconet.co.za. We strive to resolve all complaints within 14 working days.

11.3. Escalation: If a complaint remains unresolved after 14 days, the Customer has the right to approach the Independent Communications Authority of South Africa (ICASA) for further assistance.
